Legal status & protection of cultural venues

What this indicator asks

Are music and club venues in Sydney recognised in law as cultural places, and does that recognition protect them?

51.0/ 100 · Sydney

Since December 2025, music, comedy, theatre and readings can happen without a development application. A venue that was there first is protected from noise complaints by new neighbours.

A new music law, passed on 24 September 2026, creates a legal category for music venues. It has not started yet.

None of these protections reach a private lease. Divine Playhouse, a queer arts venue, held a grant and a development approval. Its landlord ended the lease in July 2026 under an “offensive trade” clause, and the case is now in court. An expert said precincts raise rents:

“When a place becomes a special entertainment precinct, all of a sudden it drives the rent up, which means that only established hospitality or creative operators can afford to move in there.”
